Description

This course reinforces that real estate licensees are not attorneys and must avoid giving legal advice by focusing instead on diligence, accuracy, and proper guidance. It emphasizes the importance of verifying information, encouraging clients to seek legal counsel, and establishing communication with sellers’ attorneys to reduce risk and prevent disputes. Participants explore the NAR Legal Pulse, analyze key Massachusetts cases such as Quinlan v. Clasby and DeWolfe v. Hingham Centre, LTD, and examine how due diligence is defined by the courts. The course reviews an agent’s responsibilities regarding ownership verification, deed and registry research, permits, disclosures, inspections, condominium documentation, multi‑unit housing considerations, environmental issues, and stigmatized property laws. It also covers contract language, common liability pitfalls, pre‑closing requirements, and the boundaries between a licensee’s role and that of an attorney. Overall, the course aims to strengthen risk‑management practices by ensuring agents know how to find accurate information, recognize red flags, and act as the “source of the source” while staying within the limits of their professional authority.
